Parents and siblings facing arrest - 498A

(Querist) 09 July 2011 This query is : Resolved
Since I am abroad, my wife filed 498A against my Father, Mother and two sisters. They applied for anticipatory bail at the district court and it's denied today. And my wife's uncle is a retired IPS officer, and he is forcing the current SP for arrest my family immediately before we apply for bail in High court on Monday. If in case local police arrest my family, are they able to apply for bail again, and what are the chances of bail granting. Our advocate said, my wife's uncle using all his connections to arrest us. Please help us and advice in this critical situation. Thanks.

Getting bail for such offences in Bengal is not much difficult.
The in laws of the complainants should have prayed for bail by surrender which they would have got easily.
Now when the AB is denied then they can apply before the high court u/s 439 crpc.

advice your parents to stay away from their house till the AB application is heard by HC...police pressure is certainly going to affect you.

...specifically raise a point that a particular retired IPS officer is creating more troubles.
