I have a spacious shop where I am doing business and a portion of it is rented out to a tenant 70 yrs back. I have filed an eviction suit against him for bonafide requirement. Now I am renting out a small portion to a limited company. To avoid my case failing against my tenant, I have been advised to get into a Management agrement where that company will show it is managing the business for me and also paying me management commission of Rs 28000/-pm. Will the court accept this and still evict the tenant.

it will be a better option to be a part of the business, however fake may be, otherwise the court will draw inference against you as far as bonafide necessity is concerned.

My suggestion is file a straight case, seek the remaining portion also for your own occupation.

One fault will lead to another fault. When the Company is Managing your affairs, whether you have to pay the Management Commission to the Company or the Company will pay the management commission to you?
