Abatement orde-computation of 90 days

for computing of period of limitation with in 90 days, is it enough if the application is filed within 90 days or the court should have ordered to issue the notice to legal representative with in 90 days.
For example appliation is filed after 80 days of death, but notice is not sent within 90 days by court

WHY ARE YOU ASKING US TO DEAL THE PROBLEM IN INSTALLMENTS ,YESTERDAY YOU ASKED CAN HIGH COURT PASS AN ORDER OF ABATEMENT BEFORE 90 DAYS???????/CORRECT.
