sir, i am from coimbatore.my tenant had his agreement on june 2011 for 2yrs. now he is creating troubles and dnt pay the rents for august month . he is not allowing any other person to occupy my another premises, now is is asking compensation of 5lakhs to vacate my premses.,what do i do to vacate him .

You need to issue him one month notice under TPA terminating his tenancy and for paying the rent due and also calling for damages for wrong full use of occupation.BUT THIS ALL ARE LEGAL THINGS FOR WHICH YOU ARE ADVISE TO CONSULT A LOCAL CIVIL LAWYER,SHOW HIM THE AGREEMENT,DISCUSS THE PROBLEM AND INSTRUCT HIM TO SEND NOTICE ,THE FILE THE SUIT OF EVICTION AND ARREARS AND DAMAGES AS WELL FOR INJUNCTION FOR HIS UNDUE INTERFERENCE OF YOUR OTHER PREMISES NOT LET OUT TO HIM. .

Send a legal notice terminating his tenancy and demand for handing over the possession after paying the rent arrears.
If he fails, present a eviction petition before the rent controller of your area.

Your should first terminate your tenancy u/s 106 of the Transfer of Property Act by giving mandatory fifteen days' notice expiring with the end of a month of the tenancy and for damages/compensation (for wrongful occupation after expiry of the tenancy). Also demand the arrear rent, if any. Thereafter file a suit for recovery of arrear rents and his ejectment.

send a legal notice for defaulter of rent and for own use, calling him to quit and vacate the rented room,if he would not comply as per notice then file a suit for Eviction of Tenant for resonable requirement and defaulter ground.

Agreement for two years not an issue. If he made default in paying rent mean legally you can evict him. He not obeyed the terms of rent agreement..

thank you all for your valuable advice. I went and spoke to him to solve the issue, he wants a new agreement in which i have to agree for supply of water , which was not compulsory in my earlier agreement. I have said that i will have to make an agreement for 11 months only. can i proceed with the new agreement. if i sign up for 11 months will i be able to vacate him after the agreement period, or is there any chances of him creating an issue, n not vacating.
