The Petitioner filed a divorce petition majorly giving two reasons 1. Adultery 2. Cruelty but finally he claimed DIVORCE under section 13(1)(ia)is it maintainable without making adulterer as party to the petition

the divorce proceeding is maintainable and to make party to adulterer in divorce proceeding is not necessary.

Divorce is a matter between spouses of a marriage in which no third is needed as a necessary party for what soever reason there may be.




yesterday i did what you are doing to day but admin is not ready to take this option back from authors then Mr.Sethi now there is no point to refuse authors on this score alone as admin is not ready to take this option back.

i agree that third party is not necessary in case diovrce is filed on grounds of adultery .

Though what experts have said about third party not being necessary for divorce on grounds of adultery is right.

However, that is not the case always. If the adultrer is someone the party knows and is well aware of the identity at the time of filing of petition, it has to be mentioned.

However, you have filed on the grounds of cruelity only, in such scenerio, it was not necessary to mention so.
