Rejoinder query

(Querist) 18 November 2011 This query is : Resolved
Sir, My friend had purchased the land from the society before the acquisition of land by state govt. authority. Recently the authority dismanteled his home partially without giving him a resedential plot as per policy of acquisition. After that he filed a writ petition in Lucknow High court for stay. The opposite party submitted the counter and court said petitioner to file rejoinder.Pls. confirm is there any time limit to file rejoinder? secondly what are the bad consequences if filing of rejoinder is delayed?
Nadeem Qureshi (Expert) 18 November 2011
Dear Yogesh
1. HC mentioned the time in Order
2. if the delay to file rejoinder then filed with application for delay condonation.
if the court think fit then the rejoinder mat be submitted otherwise not and the party lost their rights.

1]The rejoinder has to be filled with time allowed by court.
2]Delay in filing rejoinder beyond time allowed by the court can be condoned by
court on application and affidavit showing reasonable cause behind delay.
3]If no time is mentioned in the order it can be filled before next listing of the case but its copy on opposite side should served well in advance so that opposite party does not seek adjournment on the ground delayed service of copy living it with no sufficient time to it for prepare.
