Removal of fake transaction thru sale deed in the encumbrance certificate of our property

my relative purchased a plot from a person who is not the absolute owner of the property.they found it as fake transaction and caught hold of the person and got their money back and teared the document. my mother purchased the same plot through a sale deed from the absolute owner of the plot and constructed the house.recently we approched for a loan and found that the fake transaction was reflecting in our E.C. how should we get rid of the entry. my relative who was the claimant of the fake transaction passed away.his legal heirs are ready to sort out the issue of the fake transaction entry.please help me out to solve the problem as early as possiible

File an application before the concerned authority to remove the name of the person who's name is appearing.

how do you know about fake transaction? is any court declare fake transaction or not? if not then file a declaration suit for fake transaction and get declararion after that you can change the name feel free to call

File the suit of declaration against the legal heirs of the buyer [who are your relatives you say]and also against person who was their[say father's]seller.
