Section 138 : case lost

(Querist) 05 February 2012 This query is : Resolved
Hello

If you remember i asked a question about section 138 on this forum.I fought this case for an year and lost it.I have been charged to pay 1 lac with simple imprisonment.i was left on a bail bond on the order day.Does this mean i will be put behind bars even if i pay the money(which i never wanted to pay those cheater). What happens if i appeal.I am unable to find a lawyer with an honest answer.Am a girl with high values.Coming to court itself has become so distressing for me. Am being treated as a criminal for no reason.I spoke to a local lawyer he says he would fight this in the session court and would charge me 50k.Is he making use of my situation.I am all stuck do not know what to do.I gave them a security check with the trust that they would fulfil all they promised. But a training of 6months was reduced to 2and half months.I was trained by their employee with the same profile as mine. Why should i pay the amount.I donot know what went wrong on the trial.PLease help. Please help

Thanks

You can go for appeal against the conviction and penalty.

The appeallate court is having all such power to stay the conviction till the disposal of the appeal.

You need not appear in the appellate court.

I can give my opinion on merits of the case, based on the facts of the case only.

You have a good offer take it.

An eye opener for all NI 138 accused , there are ample opportunities to fight at trial court , you must utilise them.

I do not know what JSDN is understanding from your query.
I am understanding that you as employee gave some security cheque to your employer on which employer sued you and you lost and lawyer contacted you is bargaining your situation.
You have right to go to session court.
But you need to hunt another lawyer competent to deal your matter without undue bargain.
You have not disclosed the place hence you can opt from ours expert profile if some one belongs to your place.
