How to apply vrs by postal dept employee

Hi, i am dinesh, my father is an employee of postal department he is almost 55years old, due to some problem he left the job since past 6 month, he is not interest to join the duty, same thing happen in the past sometime, now we planning give VRS.

How to apply for VRS.
what are the condition.
is medical unfitt can we provide.

please some one guide me.

If he has already rendered service of 20 years or more he can seek voluntary retirement from service merely by sending a simple 3 months notice in writing on a plain paper to the Head of the Division to allow him to retire on voluntary basis, as provided in the CCS (Pension) Rules.

VRS is applicable where any VRS scheme is applicable. Since your father was working in the postal department, which is government institution in which VRS applicable, He can opt voluntary retirement by making request in writing. there is no specific format for it.

Sorry the query is vague. Unless the full facts are there advise should not be attempted. You have stated that he left the job 6 months back, the doubt is :-

(i) Whether he has resigned or merely stopped attending the duties.

(ii) If absence whether he is on sanctioned leave or unauthroised absence.

(iii) If on unauthorised absence whether he has received any chargesheet which is well expected as the standard of discipline in Postal Deptt is heard to be reasonably strict.

As advised by Mr Dhingra the employee will be entitled for pension and gratuity on completion of 3 months of notice provided :-

(i) No chargesheet has been issued by the department for any unauthroised absence or any other case.

(ii) The deptt if having issued chargesheet is willing to drop the charges for the sake of VR.

(iii) During these three months he does not receive a reply, approved by appointing authority of the post held, conveying rejection.

(ii) He actually has twenty years (240 months)paid service. Mere 55 years of age is no proof of having completed 20 years of qualifying service.

(iii) The said period of 20 years is not affected by any break in service under FR17A.(which can be expected as you said that such absences have happened in past also.

If VR is not hurdled by these factors then it is advisable placed in the circumstances.

Further, it is VR which is the right of the employee. VRS is different in which deptt offers retirement due to staff becoming excess due to shortage of business and some consideration is given to residual service also.

You have also queried regarding the employee being medically unfit. In such situation the pension will be admissible if the qualifying service is not 20 years and also his dependents are subject to existing instructions eligible to be considered for compassionate appointment. Such discharge is possible if :-

(i) The authority competent to dismiss him from service, makes a reference to the medical board indicating the circumstances which lead him to suspect the employee being medically unfit for the post held.

(ii) He attends the Board (not optional).

(iii) The board actually certifies him to be unfit.

Dear,experts thank you for your reply.

I would like to give you more details about it, his date joining of the duty 1983, but i am not sure about days,since same case happend frequently before,now he is on MC, i consulted seniors of postal employee they are telling that we can give VRS,but giving VRS he has to work for 3months as noticed period, here he is not at all interest to join the duty this is the reason why asked medicaly unfit in the previous message.

Dear Dinesh, if your father does not want to lose pension and gratuity, he would have to compromise with a period of 3 months more after he submits his notice for VRS. However, he can remain on leave on MC, if his health does not allow to work. But he must be on duty on the last working day, i.e., the date of expiry of notice period.

Mr.Dhingra sir, it means has to work 3 months, there is no alternative,but some body told me that by showing medical unfitt he can avoid working for three months.

he is not is position to compromise with any one.

sir is there any way of resolve the problem, if it is there please guide me.

Dear Dinesh,

It seems you have not read carefully my reply. He can remain on leave on medical certificate (MC) and has to be present in the office on the last working day of his VRS.
