No internal partition made in survey number

My brother purchased piece of land in one survey number, was about 24 acers i.e. 8 anna hissa in maharastra. He sales 7 anna 3 paise hissa to wind mill developing co. for construction of power station for the wind mill project. Now the company constructed power station on total 8 anna hissa, saying that they purchased the whole 8 anna hissa & also said that it is printing mistake which shows 7 anna 3 paise instead of 8 anna. What is the fast remedy?

Your brother will have to file a suit for declaration for 1 anna hissa. It is not fast remedy.

Such oral plea has no value in the eyes of law. Immediately obtain injunction order from civil court and stop the efforts of mill owners to grab your property under the garb of printing mistake.

Since the case is of Maharashtra,the necessity to construct a wind power unit requires the N.A.permission.
Inquire from the revenue authority regarding the same and if N.A. is granted then the authority must have taken the statement of the ex owner i.e. the farmer and the farmer must have stated the size he sold to the unit.
Again the tahesildar must have given 135 D notice to the vendor.
Find out the facts and follow the advise of Mr.Makkad.
