Rti act 2005 andhra pradesh

Respected Sir,
A person wants to construct a house in municipal ares and he applied for approval of plan for construction to the municipal authorities. In this connection he filed necessary documents along with the site sale deed copies to the authorities. some other person having no right title and noway concern to the sale deed property has applied for all the documents filed by the real person under RTI ACT. Is the municipal authorities suppose to give the information including sale docement? please clarify sir

Dear Mr.Trinadha Rao,

Are you sure that the person who originally applied for plan approval is the rightful owner of the land.Has the sale deed been registered? If so the Municipal Authorities have no right to provide information to anybody,even under RTI Act.This is a private matter and they should not reveal any facts unless somebody comes and produces registered documents that they are the rightful owners.You can lodge a complaint with the higher authorities.

as per section 11 of the RTI Act, without your consent, municipal can not provide information. It is purely third party information.

It is a Third Party information and the consent would normally be asked for.
