eviction case filed on basis of non payment of rent and subletting is fixed for assessment of rent.i had signed an rent agreement and paid rent by crossed cheques for few months thereafter i commited default in payment of rent. after assessment will ihave to pay rent or is there any ground i can prolong the case.sub lettes have vacated during pendency of the case and possession is with landlord.will ihave to pay full rent as per agreement or ican put forward my plea that landlord cannot claim rent in full as half portion is alredy vacated and possession is with landlord. plenlighten me.

you cannot raise plea that you will be paying for half portion only.
the default you committed has to be made good by you only.
after assessment you will get one opportunity to pay the entire rent...otherwise the eviction will follow and the rent will also be recovered by other legal processes.

You cannot take benefit of your own wrong. A wrongdoer can never claim for equity before law. You shall have to pay all arrears of rent with interest and cost.
