Respected Sir,
I am Vani. sir, My dad had one property. but my dad didn't had Education.my Dad sold my own house to other person .At the time of that registration .in that registration papers my small father put some papers and mislead my dad that it is registration papers And my dad signed in that papers .After somedays my small father show the registration papers that one of my dad property is gifted to him. now my small father occupied that property .but my dad without his interest and without his knowledge he signed in this papers.
Now we want to case a file in court.that my dad get that property.in which way we have to proceed.sir,so pls advice me.

1. Whether gift deed is registered.
2. Whether your father admited gift before court or revenue officer.
3. Whether your father gave that property to your uncle in any family arrangement.
4. If above are no, file suit for recession and cancellaion of gift deed procured with fraud mis representation and undue indluence.
If motive came in mind due to big hike / incease in price of land, than chances that your uncle will have strong proof as to why property given to him. Please mind court see equity.
