Finance Minister Pranab Mukherjee brought lawyers under the ambit of service tax in the union budget for 2009-10.
"I propose to bring certain legal services under the ambit of service tax," said Mukherjee.

Union Budget 2009 disappoints health, legal sectors
The General Budget for the Financial Year 2009-10 presented by Finance Minister Pranab Mukherjee today has caused disappointment in the Health and legal sectors.
Reacting to the Budget proposals, presented in the Lok Sabha by the Finance Minister, renowned heart surgeon K K Aggarwal said it had nothing in it for the health sector.
‘The budget has increased allocation for Defence by 34 per cent to Rs 1,41,703 crore, while the allocation for health is quite meager. For example, the budget increases allocation under the Rural Health Mission by just Rs 257 crore,’ Dr Aggarwal said.
He said though the Finance Minister said health sector has been exempted from service tax, a service tax has been imposed on transport which means that ambulances come under its purview.
‘This year, they have imposed a tax on ambulances. Next year, it could be the health professionals,’ Dr Aggarwal said.
Also disappointing was the fact that no new health insurance scheme had been announced in the budget, he noted.
‘We were expecting the Government to announce new hospitals and dispensaries besides funding for buying new and technologically advanced medical equipment. But, nothing has been announced on this in the Budget. Further, there is no mention of any support for Ayurveda and Yoga,’ the Heart specialist said.
The budget also comes as a letdown for the lawyers fraternity.
Though, individual lawyers have been kept out of the purview of service tax, legal firms will have to shell out service tax.
Senior lawyer G D Rattan said, ‘The lawyers in the Capital have already been bearing the brunt of the reduction in their clientele due to opening of the new courts in Dwarka. The imposing of service tax adds to their misery. Though individual lawyers have been kept out of the purview of the tax, it is feared that in years to come, they might have to fork out a big chunk of their income in form of service tax.’ Another senior High Court lawyer Mirdanshu said, ‘In these times of recession when many clients have become tight fisted, the service tax on legal professionals comes as an additional burden on the lawyers.’

Lawyers oppose service tax
Central government's move to impose service tax on legal consultancy service under the union budget for 2009-10 has not gone well with the lawyer community. The bar association and lawyers have opposed this move by the Centre.
Expressing his discontent, senior member of the Ahmedabad Criminal Court Bar Association, Gulab Khan Pathan said, "We oppose such move by the central government. We will decide the future course of action after studying the proposal in detail and make representation in this regard after discussing the issue at the Bar Council of Gujarat."
When contacted, Yatin Oza, former president, The Gujarat High Court Bar Association told DNA, "It seems that, the legal fraternity is being targeted by the central government by imposing service tax upon legal consultants. This is a frustrating move. Legal consultancy should not be treated as a service for imposition of service tax."
Expressing similar view, Krishnakant Vakharia, senior counsel of Gujarat HC, said that consultancy and advice was beyond the scope of service tax.
He said, "Consultancy and advice regarding legal issues is beyond the purview of the service tax. By providing legal advice, we are also helping society to maintain law and order. The lawyer fraternity should be excluded from scope of the service tax and the central government has to withdraw such proposal."
Office bearer of Bar Council of Gujarat, Anil Kella said, "We oppose the move. Such provision will create an obstacle in providing speedy justice and ultimately the people seeking justice will suffer."

Lawyers' strike over service tax
A day after Union finance minister Pranab Mukherjee proposed getting law firms under the ambit of service tax, lawyers of all five district courts in the capital on Tuesday decided to abstain from work on July 9 as a mark of protest against the move.
"Lawyers of India will not tolerate any attempt by the government to impose service tax on the legal fraternity and shall adopt all peaceful means to oppose such uncalled for and unwarranted taxes on lawyers," the coordination committee of all bar associations of Delhi said in a statement.
As part of the Union Budget, Mukherjee had on Monday proposed imposition of service tax on advice, consultancy, or technical assistance provided in the field of law.
The coordination committee stated that the legal profession could not be considered as trade or business. It was exempted from service tax as it could not be equated with commercial activities and services provided by others for gaining profit, the lawyers body said.
"The government seems to be labouring under the impression that the advocates' profession is a commercial activity. The fact is that the profession is noble and meant to advance promotion of administration of justice," Ved Prakash Sharma, chairman, BCD, said.
