(Querist) 09 June 2012 This query is : Resolved 
A's grand father purchased a land from B about 50 years back and A was put in possession of the land. but unfortunitly purchaser name was not entered to the land in question. subsequently A died and B also died survivors came. B's sold sold the same property to C about 2 years. A's grand son till today in possession of the land by virtue of purchase by his grand father. what is the position of A's grand son

A's grand son has to file suit for declaration and injunction on the basis of the sale deed which was executed in the name of his grand father.

If the land was purchased by registered Sale Deed the grand son should file a suit for Injunction only and not for declaration as it will attract more Court Fees. Please note that as the provisions of Registration Act when sale is by Registered Deed an entry must be made in Revenue records on an intimation by Sub-Registrar (Though it is not being followed). Even otherwise revenue Records are for fiscal purpose only and it will not affect the title of grand son and more so when he is in possession.Nothing to worry about this.
