An agreement is to be executed by four pvt. ltd. companies viz. ABC (P) Ltd.,ARC (P) Ltd.,XYZ (P) Ltd., and PQR (P) Ltd. Mr. X is a common director in two of those companies viz.ABC (P) Ltd., and PQR (P) Ltd.Can he sign the said agreement on behalf of ABC (P) Ltd., and PQR (P) Ltd.as their authorised representative?

In my opinion there should not be any impediment, for the simple reason the companies are distinct juristic persons only represented by the common director. It is not as if director is entering into a contract with himself.

advisable to have different directors sign on behalf of companies to avoid any controversies in future .

I also hold the same view as stated by experts.However,I desire to know whether there is any specific restriction in this regard in the relevant Act,before putting my advice to somebody,who has asked me?
