Absence of acknowledgement receipt

Sir,
my department has suspended me on ground that I did not utilised the fund so trasnferred. But my contention is that I never received any such letter till the close of financial year so how can I utilise it.
Thus I would lik to know from your goodself that whether there is any ruling of any Hon'ble Court stating something like ' absence to produce receipt of acknowledgement tantamounts to failure to deliver the things from the originating station.' or something like above.

It is a matter of fact. You have to prove the same in the Inquiry.

Sir, I can only say that I did not received the papers. Else what evidence can I produce to prove that I did not receive the letter? The sender should produce the evidence not the recipient. I presume. Pl advise.

You have to submit list of defence documents which will prove that the acknoeledgement sought by you does not exist.
You want to say that you did not receive the paper. For this you have to forgoe right of silence during evidence and become a defence witness. The moment you are witness you are exposed to cross examination by PO.
