Landlord highjack my shop.

(Querist) 07 November 2012 This query is : Resolved
I have a shop on rent in delhi. My father take it on rent almost 30 years back.

Suddenly today When my father reach the shop to our surprise we found the shop changed to a dealer's office. My all the goods are dissappeared. There is no trace of my old shop. When we shout, people gather but the 'gunda' present there has abuse us. We call police. They ask us for rent receipt. We don't have that. We never take any receipt. Either we don't have any agreement.

What we do now ? What legal options available to us ?

you must be having electricity bills , telephone bills of said shop .rent receipt is necessary to show that you are the tenant

Law requires proof of everything. If you were in the shop as tenant since last 33 years then you must have some evidence in your hand which may prove your claim. if th esame exists then again approach police authorities and then before rent controller and resume your possession back.

what was the nature of business. Whether any licese was required.

Whether any material was supplied on site by suppliers.

whether ay notice/sumon/regd mail was received in the past.

whether you were even fined for any municipal violations in that premises.

whether you can muster the evidence of the customers.

30 years is a long procedure there has to besome evidence unless you never occupied that shop.

you mean it was an oral tenancy without proof of receipt payment of rent.

Then you need to prove it by other circumstantial evidence such as electricity connection if it was in your name;or shop registration certificate;telephone bills if any, etc.
