my friend has instituted a partition suit and the suit was decreed in his favour and has got 1/7th share in that but he has not gone for an ep... and other 6/7th share is being divided into his father and his two brothers and three sisters... my friend lives on the ground floor of the property and its a three storied building and he wants to occupy the said portion and he asked one of his sister to give her share and she is ready also but my friend is not getting which kind of document is to be prepared among him and his sister so that there shall be no future litigations among him and her legal heirs and other shareholdrs in the property without executing an ep...

Her sister can execute a registered Relinquishment deed and get the same recorded in the relevant records of municipal authorities.

can i know wat is format of that relinquishment deed...
i want to know one more thing my friend dont want k the legal heirs create a problem for him in future... shall he registered that deed or registration is not necessary

The willing sister can execute gift deed as well as in gift deed the stamp duty is minimal.
Registration of deed is compulsory.

There is no need to have the format of relinquishment deed. Both need to go to the compound of registrar office wherein the deed writers can do this job easily at very nominal rates. Get this deed registered and don't forget to get sanctioned mutation in the revenue record so that all future problems may get ended as desired.
