Is divorce possible...

(Querist) 17 December 2012 This query is : Resolved 
One of my relatives is a 50 year old lady employee and has marital problems ever since she got married way back in 1980. She has two grown up daughters and have reached marriageable age. The couple is said to be having misunderstandings and incompatibility from bigining and never had peaceful living. Her husband is a retired govt employee living separately for the last more than 5 years and never helps in household affairs. He doesn't even fund to run the house. Mostly, the daughters have been brought up in every way by the mother only. The husband had sadistic attitude too and tries to spoil the inter-personal relationships between his family members and relatives. Also, he spoils the marriage proposals of the daughters with his mal-propaganda. Now, she is very much perturbed and wants to separate from her husband to prevent him from interfering in family affairs and also to ensure that her daughters atleast will have a peaceful living ahead. Both the daughters are also fedup with their father. The lady is sure that her husband will never agree for divorce. Is it possible for her to get a quick divorce given the situation as explained ? She is not interested in any alimony.

Quick divorce is not possible. Only consent divorce can solve her problem.

Contested divorce is not easy, it will take time, if there is any customary law or tradition in this family it can only be possible otherwise not.

There is no way for quick divorce unless both of them agree for mutual divorce.

The lady can file case of domestic violence against her husband.

since huusband wont agree to divorce file case under DV act for maintenance and other reliefs . as compromise husband may agree for divorce by mutual consent

MCD is the only solution in the given facts but it shall also take a period of minimum 6 months after filing of the petition. Try to reconcile.
