Submission of evidence after final argument by defense side.

(Querist) 18 January 2013 This query is : Resolved
A false case was booked aginst my family under sec. 498a,34,341,323,379 in jan-99 by my sister-in-law after the death of my brother as i refused their proposal to remarry her.Trial commenced from 2001 and all the proseqution and defense witnessed deposed alongwith all the relevant exibits. Then the case was closed for final arguments in the month of Dec-12 at the insistence of proseqution side.Final argument by defense is over and date was fixed for argument by proseqution. Now they have given a petition thet thet want to exibit the injury report and examine the doctor issuing it which they had not done during trial. My query is does the law permit it at this stage,as the case has dragged on for 13 years and the complainant having booked a false case want to drag on the case to harass us .May i know what do i do now and what rejoinder do i give for geting quick judgement.

You are required to strongly oppose the application. As the onus is upon the applicant/complainant to show the law under which such application can be got entertained, you need not to worry it but keep on opposing on the basis of delay, already having knowledge of such evidence and having no procedure at all to lead the same on the part of complainant rather of the prosecution.

oppose said petition strongly in court and try to get it dismissed by court.

Thank you so much for your much awaited reply. We will oppose it tooth and nail. Still i would like to know wether it is permissible by law and if so under what section.I am apprehensible as it is a lower court .
