In that case whether its advisable to file the "rejoinder affidavit" or rejoinder supported by affidavit as done in petition supported by affidavit

Raj (Querist) 21 February 2013
sir, written statement will have to be file by the respondent which he has already file..
ajay sethi (Expert) 21 February 2013
in a suit after defendant files written statement then there is no scope of filing affidavit in rejoinder. it is only wherein any interim application ie notice of motion is taken out then you can file affidavit in rejoinder
R.K Nanda (Expert) 21 February 2013
file rejoinder with ur supporting affidavit.
Raj Kumar Makkad (Expert) 21 February 2013
You shall have to obtain prior permission from High Court for filing rejoined affidavit if there are any new facts which were not earlier known to you in the written statement filed by respondent may it be without supporting affidavit.
Devajyoti Barman (Expert) 22 February 2013
If his statements are not supported by affidavit, then you may not file counter affidavit.
