Help form the court to give the instructions to police authority.

Dear all,

Greeting you,

I gave a complaint for threat to kill, extortion & criminal intimidation at Police Station using India post. which is already received around 10 days back but till date police authority haven’t take an action against the accused persons.

Please guide me what I should to do, do I need to take the help form the court to give the instructions to PS for arrest or take the action on same?

If it’s possible so please confirm that in what section it will consider & how I can proceed or tell me the procedure for same.

You can file a Criminal Case u/sec.156(1) Cr.P.C. in the Magistrate Court charge with sec.384 and 506 IPC.to your complaint treating as an FIR.Failing which you can file a Writ Petition in High Court for in-action of police authority.

You can file petition u/s 156(3) crpc. In alternative you can file Writ petition for police inaction.

The period of 10 days is not much more for Indian police to move in such cases. It shall be better to remind the police authorities before you proceed towards the procedure of private complaint to be submitted before court.
