Cognizable offence

Respected experts,

As per my knowledge, the penalty for cognizable offence may be higher than non-cognizable offence.IF A DRUNKARD (ASSHOLE) RAPED SOMEONE ,,,THEN SUCH OFFENCE IS COGNIZABLE OFFENCE OR NON COGNIZABLE OFFENCE? AND PUNISHMENT IS HIGHER THAN NON DRUNKARD PERSON?

MY INTENTION IS TO JUST EXCHANGE KNOWLEDGE.I ALWAYS RESPECT ALL WOMEN.THERE IS NO MENS RIA.
