Caviate

Respected Experts,

In my earlier query regarding mutation on basis of will was inquired by the Concerned Tehsildar and he has directed our opponents to go to the civil court.

So Can I file a caviate in the civil court. How many days the caviate will in force.

Section 148 A CPC prescribed for 60 days, but it remains in force longer than that.

if your opponents go to court you will be served with notice before probate is granted as you are one of the legal heirs of the deceased .file caveat if you so desire

The caveat will remain in force for 90 days from the date of filing and can be extended for a similar period by making an application / a petition referred to in sub-section (1) of sec 148-A before the expiry of 90 days.
