Framing of charge

for the offence punishable under Sec.302 of IPC, who has to frame charge? Sessions Judge or the Magistrate has to frame and commit to sessions court?

It is the seesions court to frame charges. The magistrate can only commit the accused to sessions court for trial u/s 209 cr.p.c. The sessions court then proceeds to frame charges.
