The property where we reside will be going for redevelopment. We all are tenants. The builder wants to construct two buildings, one rehab. building for tenants and one building for sale. Can the tenants demand to get their flats in the sale building only?
The quality of the rehab. building will be poor. Do the tenants have a right to demand their flats in the sale building only?
Please help.

you cant generalise that quality of rehab building will be poor . builder is giving you more area and ownership rights of flats . appoint a structural engineer to verify quality of materials used . be pro active .
it all depends upon your bargaining power with the builder

I fully endorse the opinion of Ajay. Do bargain with the builder to maintain the same quality of construction in both buildings.

You have all the rights. It is a matter of bargain.Do not fall pray in hands of unscrupulous builders who may ply by night showing you thumb.The all Mumbay architects and lawyers are engaged in understanding Funguble FSI rules amended recently in 2012 .
