(Querist) 24 May 2013 This query is : Resolved
sir, i have a recording in which eyewitness accepted in the presence of media that i am not present at the place where this criminal offence happend.
sir under which section we use this evidence and is it enough to wash out the fir registered by the eyewitness.

you mean to say witness has named you as the culprit and subsequently confessed before media that false fir has been regd . when cops call you for questioning draw attention to the confession made before media . cops will investigate the issue

sir the case is, my brother & 3 more people was named as a culprit for murder under the political & police pressure but it was done by only one one man and my brother was not present there at a time of criminal offence.
the FIR registered by the man is claimed that
he was present at the time offence but he confessed before media that he was not there.
is this confess is usefull for me any type in court??
ajay sethi (Expert) 24 May 2013
yes it would be useful .at time of murder where were you ? you must have alibi mentioning your presence in particular place at that time . draw attention of cops to said fact
