Joint ownership of flat

(Querist) 26 June 2013 This query is : Resolved 
I own a flat alongwith my 2 brothers. However, entire payment is made by me. The proportion of ownership of each brother is not mentioned in the purchase agreement. A partition has taken place between we brothers and the said flat has come in my favour. Now, we wish to make some document on the basis of which I don't require the signature of my brothers at the time of selling the flat either before or after their death and there are no claims from their legal heirs. My brothers are ready to sign any document for this purpose. Suggest me a way out.

contact a local lawyer . the brothers can execute deed of relinquishment and you can then transfer flat in your name . have document duly stamped and regd

your borther has to execute the regd., rights relinquish deed.

a registered relinquishment deed by brothers in your favor would do the needful;

else get the partition arrived at in writing showing flat to be in your exclusive share and get the partition deed registered.

If a family settlement has been executed between you brothers then the same family settlement is required to be got registered which automatically shall change the ownership accordingly. Mutations can be got executed thereafter.
