Dear Sir, have one case in my hand and seeking your kind advise :
In 2003, One of my friend had detected in one case of customer where 1.26 lac of goods were exported in the value of 26 lac for the purpose of DFRC.
at the same he was arrested and got bail after 15 days remand in jail post submitting Rs. 1Lac as bail bond.
Now there are two cases are running is one as criminal and one in adjudication.
in case of adjudication there was 5 lac rupees penalty on the company whose prop. was my friend and one lac one my friend name.
post making appeal filed in HC, final decision received on 2nd sep 2013 where one lac rupees in the name of my friend was deleted and 5 lac penalty was levied finally in the name of the company.
Now seeking your help as there is any further chance of making appeal to this order.. as the financial condition of my friend is not good.
or what is the solution..how is the recovery made.
what happened if he don't make payment.

Without going through the decision of the court, it is difficult to advise whether sufficient grounds exist for appeal or not.
Appeal will be a costly affair, may deposit the penalty.
In case of non-payment imprisonment proceedings can be initiated.

It shall be better to discuss the issue of the lawyer of your friend dealing case at high court as he is well acquainted with the facts of the case.
