Draft for discussion without prejudice: on stamp paper

(Querist) 10 December 2013 This query is : Resolved
I would like to know the meaning / ramification of having the heading/title of a business agreement (signed on a Rs. 50 Stamp paper) "DRAFT FOR DISCUSSION WITHOUT PREJUDICE".

The agreement details the roles and responsibilities between two parties where the first party manufacturers goods and the second party has agreed to sell the goods to a number of different third parties for a commission on the total volume of sales.

We are the second party. So does this mean that whatever commitments the first party have made on account of commissions or exclusivity of the customers introduced by us cannot be challenged in a court of law if not adhered to by the first party ?

Please advise.

Sir this not an academic query. This is a genuine case because while making another agreement for a different principle we realised this. So please help.

You may have in your terms and conditions of agreement a clause mentioned that all disputes to be referred to the Arbitrator, if so, the issue my be taken up the arbitrator.

This is purely an academic query hence no reply.

What's wrong with you Mr. Makkad ? If you think it's an academic query, then let it be. I'm amazed that you'd read a post, then take the time to write down that it's a academic query and "no reply". Seriously?
