Query regarding "agreement to sale"

Respected Sirs,
Whether an owner of the land (whose land was, earlier, acquired by the govt. for some public purpose, but later on it was declared to be handed back), can enter into an agreement to sale it. Also whether he can proceed with sale of such land ( the possession of which he is still to receive ) by preparing 'banakhat'. And if yes, it would be kind of you, if you could let me know, what important points should be covered while drafting a banakhat in such matter.

The owner of land can always sale by way of executed contract or executory contract.
For points you have to take help of an advocate.
