For mutual divorce

(Querist) 29 January 2014 This query is : Resolved 
dear sir/ madam,
In mutual divorce,I want My wife will be 1st petitioner and I, 2nd petitioner but my wife didn't agree to be 1st petitioner.If I will be 1st petitioner then , will I face any problem in future.Please suggest me as soon as.

There will be no problem either now or in future just because you become petitioner 1.

It is of no issue as nothing will mean by order of petitioner. This is mutual petition and order of party would not change the character of mutual consent.

It is a fit case for divorce with mutual consent!

I agree with Mr. Rao's observation on the issue. He has rightly pointed out that it is a fit case for divorce, i.e., if the spouses do not agree even for this petty issue, how will they live a long married life. The petition has to have both the names as petitioners, there is no priority on the basis of number in the decree of divorce.
