Hi
Could anyone pls help me... we filed a case regarding a property.we paid the advance and the owner doenot had the original doc which are mentioned in the agreement.the owner is not attending the summons and now he sold his property to some other with out settling our issue..how can we procced if he didnt receive the summons

Agree with the experts. In addition, make the new buyer also as a party to the suit.

yes, by taking permission from the court for substitute service of summons, you may also implead the new buyer as a party to the suit.

As all of u said we tried to include the new buyer in the suit but they refused to do so.we heard that as the owner of the property changed the new owner should pay the amount that should come to us.In this case to whom we should send the summons either to new owner or to old owner?
