Dear Sir, i purchase Re-sell flat on 15-11-2013, with payment of token amount with balance payment period of 90 days, which expire on 15-02-2014
in token agreement, their no clause added, if payment not done on 15-02-2014,
i got full document to apply in bank on 05-01-2014,
my payment delayed due to delay in bank home procedure and title clear documents,
now what are my rights, to claim on that flat, as clause in token agreement is slient, regarding penality or delayed payment or forfiet of amount as per seller.

Request the vendor to extend the time for making the payment of balance of sale consideration amount beyond the stipulated period of time quoting the delay in sanction of bank loan.

write to seller informing him that you are willing to make balance payment now . mention reason for delay in making payment . wait for his reply .
then decide your next course of action accordingly .
these days it is difficult to find buyers for flats . seller will be more than willing to extend time

Take up with the seller in writing (registered post AD) to extend the time for registration of deal. On receipt of reply, if request not accepted consult local lawyer.
