Respested Experts,A entered in to Sale Agreement with B to sell his property and later returned the Advance amount . In spite of taking back Advance B filed a Specific Performance Suit against A and got the Judgement in Favor of B in Fast Track Court .Now Appeal is pending in High Court Bench/Mean While C had filed a money Suit against A stating the Loan was Prior to Sale Agreement between A and B and Property is attached by High Court in favor Of C.Now Please Confirm What Would Be the Hold Of B.How he could Succeed .Our Family My Father is Only C Please Guide and Your Valuable Suggestion is Begged

at time of retrun of advance amount did A obtain letter from B that refund of advance amount was in full and final settlement of all claims .

it is necessary to go through specific performance suit filed , judgement passed by fast track court and your Appeal .

since you have already engaged a lawyer go by his advice .

whether in suit proceedings between A and B attention of court was drawn to attachment of property by court . it appears property was sought to be sold by A in violation of court orders . B wont succeed if court is made aware of attachment orders

Thanks For Your Concern Mr Ajaj Sethi ji.B had paid advance amount by cash and A had returned it as Demand Draft which was encashed by B.In spite of this fact FTC had given orders in favor of B. C my father had filed the money suit after this order and C "s Money agreement with A is prior to B's sale agreement with A.C my father had filed first case in Single Bench High Court,Then With Bench high court for Single Bench Reducing the interest and Later with Supreme Court for Reduced Interest Amount.Supreme Court Dismissed the Case On Admission.Could your Good SElf how far B is strong in his case and the Status of my Father C Please
