Sir,
3 MONTHS before I attended an interview of a company and after 4 level of interview they asked me to produce the last 6 months salary certificate. but even after many days they didnt informed me anything. I was continuously following up them but they were dragging . and after 3.5 months they said I am not selected. my query is after the interview how can a company ask a confidential document like salary certificate without confirming my interview status ? I have doubt that they mis use these details . can i file a case aganist them ? please help me with your valuable answer.

no you cannot file case against company . it is at discretion of company whether to employ you or not .

Yees it is the discretion of the company to employ me or not but how can they ask my confedential certificates before they decide whether they select me or not? normally all companies ask for the certificates after they select the emploeee. also this company was intentionally dragging the procedure to 3.5 months while asking me several certificates . I want to file case on this .

You could have declared the last drawn salary/CTC in 'Vitae', job application and if required shown the last salary slip.
Salary Certificate is usually asked if salary slip is not available.
If candidate is negotiating annual pay package over and above as in last employment then there is nothing wrong in showing the last salary slip.

The question is, what is the use of operation or disection of a body, except for the purpose of postmortem, when the person is already dead?
So, when you have already produced the last 6 months salary certificates long back, there is no use of asking now "how can they ask my confedential certificates." You could well have asked this question to them or got opinion of the experts before submission of your salary certificates. You could have flatly refused the company to do so, if you considered the documents to be confidential.
You have alreay lost the case even before filing when you have agreed to their proposal and submitted willingly without questioning about the purpose or their intention at the time of demand.
But still, if you want to file a case, you are quite free to do that if you have time and money to spare simply for losing the case.
Of course, if you have any evidence of misuse of your salary certificates or information thereof by the company, you would be quite justified to do that.

The prospective company can ask for any documents to finalize the interview process. If the prospective employer does not select you, you have no grounds to file a case against them.

I agrees with all your suggestion. but please note that the company has asked my certificate informing that I have been selected . before sending my document I confirmed to them that whether I have selected they said yes.. but after getting the certificate they simply dragged the process and later after 1 and half month they said my skills dosent match. so they have really misleaded me with false information. So as many of your suggested I can do anything on a company who misleaded me with false information ?

Did the company inform you in writing about your selection? If not, how do you propose to prove the correctness of your statement in the court of law?
Further, if they informed you verbally, you could well have asked them to ask in writing to produce salary certificates while informing about your selection.

Yes they informed me through SMS to send the 6 months salary certificate. I have that SMS send by them with me.
I don't bother about getting or not getting a job in that company but my only concern is that How come they collect my confindential certificate by giving me false information ( verbally they said I am selected )
This is a startup company . is there any way I can take this to Ministry of corporate affairs informing them what has occurred so that they will be strict to this company in future.. I don't want other candidate to do my fault... There are lot of startup companies who are not aware of the corporate ethics.

If they have simply asked you through SMS to send salary certificates without mention about your selection that cannot prove anything against the company, as the company can very well say that they had never assured you about selection and that the company has the right to seek any valid information from the applicants pertaining to their previous job for verification purposes. You can lose your case simply on that ground.

ok sir thanks for your advice.. but only thing I can do now is to discuss with my friends and others about my experience with this company and make them aware not to accept any interview calls from this company isn't it ? :-) thanks for taking your time and giving me your valuable advice sir...

Always, due cautions are required to be taken before acting on the direction of the interviewers or the company management. You cannot anticipate, what is in their minds and why they are asking the candidates to do something according to their wishes.

You may certainly share your experience with colleagues, peers, friends and make them aware of your learning's.
However be choosy and cautious of words you choose.
Let the individuals who had interviewed and resorted to only verbal transactions also become popular.
Prefer to transact in writing even if by email.
It is better to finalize the payment of expenses to attend interview in advance and obtain confirmation preferably in writing.
There is no dearth of companies with practice of paying full expenses.
You may demand to return the salary certificate by redg. post.
