Transfer of name from joint a/c

I, Bharathi Mogga, having a flat in joint name with my mother. But my mother unfortunately had expired 2 months back. Now I want to remove her name from the joint ownership and include my brother's name. I am unmarried and staying with my brother and his wife and 2 children.
Please let me know the procedure.

any nomination form filled in by your mother for her 50%share in flat ? please clarify . if so your brother if he is nominee can apply to society to transfer 50%share of flat in his name . you can give NOC in this regard

No nomination form has been filled by mother.

Dear Mr. Venkat Mogga,
1. As you say that no nomination was made by your mother of her share in such property then in that event the society will not be able to transfer her share in the name of your brother.
2. Now, the way out is that is to get a succession certificate form the court and then the share of your mother would devolve upon both of her sons and later their names will be required to be mutated in the municipal tax bills showing them owners and then you can have the society incorporate the mutation in name of your brother in the share certificate.
