Can universities and private hostels can be constructed in mosque's land?

Dear All,

Good Morning,

i have a query and i would like to have the valuable suggestions from you.

Near my house there is a mosque land and the person who runs the mosque has constructed university and hostel in that land.. Now he wants to construct another hostel for girls in the said land and started building a wall which closes half of the entrance of the mosque through which people enter into the mosque and do prayers.

All the people have objected for the same, that is closure of entrance as it will be congested for them to enter, but they are not against the construction of Hostel.

But still that person continued with the same and few people has destructed the wall to the extent which covers the entrance.

Now that person has filed a complaint against those who are involved in the destruction of the wall and also who are not involved also.

But i have no idea under what sections the case has been filed. But the thing is all were in the Police station now.

The complaint has been filed in the morning 10'o clock on 11-August-2014 and they are in the Police Station since 5 pm on 11-August-2014.

My question is:
1. Whether a person can run a University and a Private hostel in the mosque land?

2. Whether we can file a written Complaint under 339 - Wrongful restraint?

3. How to proceed in this case?

if he has obtained requisite permission from Muncipal corporation he can construct a private hostel . file an RTi application to find whether building plans have been sanctioned by the corporation on the mosque land

If the entrance to the mosque is closed / effected, file a case and get injunction from court.
