Conveyance of a building

(Querist) 12 January 2015 This query is : Resolved 
Our Building is now about 43 years old. The builder has still not convened the property to us. Society is formed since several years. It is on a sub lease land. What is the process to get it convened.
Also has the society to pay for conveyance amount expenses or has the builder to incur all the expenses. Please advise. Many thanks

you can opt for deemed conveyance . society has to incur the expenses

If the developer is not coming forward to convey the property to the Society, the Society may apply to the Competent Authority under the MOFA Act for deemed conveyance. If all the flat owners have registered their agreements for sale, the stamp duty paid on the registered documents will be adjusted from the duty now payable on the conveyance.Before u approach the Competent Authority you have to issue legal notice to the Developer demanding execution of the sale deed and comply with the requirement of the Rules framed under the Act.
