I had file an appeal for rti but in appeal proceeding the PIO has taken the ground that I have already posted your information through simple post but I have not received any such posted by him . My question is that whether the PIO can deposit RTI information by simple post and another thing is that he does not give any notice regarding expenses instead of receiving any expenses he has posted the information through simple post. Whether a information posted by simple post is valid. The most important thing is that he posted information after the expiry of period of 30days and information is incoplete . They said that they have only that much information. Then what is the ground appeal from my side. Plz tell me in detail with legal grounds for appeal

1. You entitled to get the information on free of cost as the information sought by is furnished to you after 30 days.
2. Whether it is posted simple post or registered post is immaterial now, as you have already received the information.
3. As the PIO mentioned that the available information with the Public Authority is already furnished, you have no ground in the first appeal.
4. If you have evidence to the effect that PIO has misrepresented the facts, you can provide the same to the first appellate authority.

Well advised by Mr.Srinivas. But for incomplete information you can represent to appellate authority within 30 days from the date of receipt of reply. If you have received the information why do you bother about sending by ordinary post?

Sir one thing a have forget to tell you that when i go to file first appeal on the same day they have posted the information. And whatever they have posted i yet not receive the same & i have received the information in first appeal hearing. So on this ground what you suggest
