Remarriage without divorce

Sir, my brother is working in malasia and he recently fall in love with a malayi lady. she is already married but due to some personel matters now they living seperately. but divorce is yet not processed and she says that his ex husband will never give her a divorce. now my brother returned to india. can she come and marry my brother in india without getting divorce. what are the procedures to be follwed for the same..

The personal law applicable to both your brother and lady may prohibit such marriage.

Ask your brother to stay from such relationship.

Probably he want to marry for the sake of getting residency but may get trapped in penal code on returning to the foreign country.

sir, she saying that she cannot live without him...she may legally change her citizenship as indian. however is it possible for a remarriage without getting divorce. if so what are the punishments

Look into personal law/law of the land that is applicable.

Beyond this discuss with an able lawyer in perosn.
