The child of 12 years tutored by my ex-wife and does not even talk a word with me in spite of appearing before the family court. Counsellor (13 times ). The reason given is that the child is not willing. The relation with the child were affectionate before the divorce.
The ex-wife now seeks maintenance as was agreed upon in mutual agreement. At that time the ex agreed to the terms of access to child as framed by the court. She took away the part of money and then set the child against me.
What is the remedy now. Are there court case where the courts have stopped the maintenance to the tutored child.

You can take a legal action against her for the ill treatment to the child.. gather the evidences for the same and then go for it. But you issue seems more like family grudge.

My case has superb merit based on documentation that the child is alienated from father by mother but the mother is taking a stand that the child is not willing and no force could be applied. This is just a technical point used by the mother. Mother has even not brought the child before the court for meeting the child on several dates.However,when the child comes, she does not talk a word. I have already paid one installment of maintenance an another is due. I do not intend not to pay but only want access to my child whom I am unable to forget.
The citations of higher courts cases where maintenance is linked to access will be highly helpful as a support.There must be some cases of where the courts have done justice to fathers against the mischief of a woman with the help of a crooked lawyer.
