Hsg society in mumbai

(Querist) 27 February 2016 This query is : Resolved 
ground floor member extended his flat by taking in the Society owned flower beds and fitting aluminium sliding glasses therein. Society says they had it in writing from the member that she would correct the wrongs and go back to original. Now Society says that the letters from the member have disappeared from the Society cupboard and "they suspect" Manager who has left services. No action thereafter taken by the Society and understand the flat in question has now been put up for sale with area increased by the illegal extensions.
What do the members do when more than 12 lakhs worth of Society property now lost?

Society should take steps to get the illegal occupied area.

Should not issue NOC for sale.

INTROSPECT ON THIS:

1. In a court of law, HOW will the Society prove the ownership of the "flower bed". What documentary evidence is available to show that "flower bed" is the property of the society ? ? ? ?

2. At the most Society may inform the local Civic authorities (BMC, PMC .... ) about the illegal alterations /additions which may be required to be proved by relevant documents.
