Leakage in housing society

The leakage is from my wc to down floor flat wc. The leakage is present from 1996 before I take possession. I am not making any changes in flat. So who will bear the charges for repairing. BMC is harassing me for repairing. And what percentage i want to share for repairing.

As the leakage is from your flat it is your responsibility to get the leakage repaired.

1. According to Society "MODEL" bye-laws, intra-flat leakage fixing expenses are to be mutually borne by the affected Flat-Owners.

2. According to BMC Act, YOU have to fix the leakage, at your own cost, failing which Criminal Prosecution can be launched, against you, leading to Penalty.

It is otherwise genetelmanship that none should suffer because of our lethargic attitude. Even if you have not deteriorated the property and it is in the same condition as of 1996 even then you are morally as well as legally bound to get it repaired.

I am ready for repairing but as per bye laws the flat owner not want to spend 50% of his share amount.
