Lawyer

(Querist) 27 February 2010 This query is : Resolved 
I have hired a lwayer for allahabad high court from chandigarh. I ahve paid a huge amount in advance. From past 9 months he is delaying the case.He has not attended the court. Counter affidavit has been filed from the opposite party but my lawyer has not replied to it till now. He is avoiding it.What could be done against him

Better to have a talk with your lawyer and ask him for the reason to delay.

First of all remove him from the matter and engaged a new lawyer. then write a letter to that advocate and ask him for such delaying and neglency. if you find some reason then you can file a complaint before bar council and also claim damage with which you suffered and return of your fees.

If your advocate is not fulfilling his obligations after acceptance of brief and receipt of fees, you can file a complaint of professional misconduct against him before the Bar Council and can also sue him for recovery of the fees not earned by him. But before initiating such legal proceedings, it will be better to get your brief from him and engage another lawyer so that your case is not adversely affected.

Yes file complaint before the consumer court in your jurisdiction for profeesional misconduct and code of ethics.
