Contradiction in FIR

Ld counsels,

How contradicting statement made by complainant will be viewed by criminal court.

When the contradiction is of such a nature that the two statement cannot be fatually possible or co-exist.

Also how different versions of an incident will be viewed.

well if the contradiction is material in nature then certainly help in acquittal of the accused....however in criminal trial whole set of facts and evidence adduced have to be appreciated...moreover the offence is to be proved beyond reasonable doubt.

contradiction and ommissions in the statement should be see very cautiously. Minor contradictions in the statements of witnesses doesn't always amount to fatal for the prosection. Cause it's very difficult that two person stated word to word exact story like xerox copy... they can be suspecious or tutored one... but contradictions on material fact is no doubt fatal for prosecution..

Necessarily the contradictions may be taken out as defence and the same can be against the complainant.
