Faulty Microtek Inverter

Respected Experts,
I had purchased one microtek inverter from Patna, some 5 yrs back by paying Rs. 3600/. The wave form on that it works is “tpzi”. At that time they convinced that it is a latest technology, which gives far more battery backup and only Microtek is having this technology, it is best in this class of Inverters. Contrary to that most of the electrical appliances works on “sine wave”. I started using it, within a month, tube light set with choke got fused. Other appliances like fan etc. were making noise. So, I packed the Inverter. After some time I asked to other Microtek dealer about this problem. He said to me that the wave form “tpzi” that your inverter is based on is not good for electrical appliances having windings, only “CFL” can be used and now company has stopped producing/manufacturing it and now only pure sine wave inverter are being produced/manufactured. Now some months back I wanted to clarify this from the company by sending mail, also whether it can be converted to sine wave or not. They replied diplomatically that “It cannot be converted to “sine wave”. But they are silent on its’ harmful effects on electrical appliances having windings. Now I am not using that inverter due to fear. What should I do? Plz. Suggest. My thanks to all.

You have been silent on the issue for almost 5 years and further you have not used the inverter since then.

For availing any remedy, a period of limitation has been prescribed within which you can initiate litigation. After expiry of that period, the litigation becomes time barred. You have stated that you purchased the inverter five years ago and the defect was detected within a month. As such, you can neither avail the remedy of Consumer Forum (2 years) nor the civil suit (3 years). Both remedies have become barred by time. Law does not protect a person who sleeps over his rights.

Sir, I stopped using due to fear of appliances being burnt as advised by the mechanic. Also I thought that I will get it converted to sine wave, when I require it. I was not knowing that it can not be converted to sine wave. Also after extensive trial company should launch any product. Also there are company's who have rolled back faulty appliances. THANKS

Yes I do agree with u sir, but on the other hand Hon'ble SC also says that inability to take action does not takes away the right. thanks

Please note the observations of the Hon'ble Supreme Court of India in case titled 'P.K. Ramachandran v. State of Kerala' reported in AIR 1998 SC 2276:

"Law of limitation may harshly affect a particular party but it has to be applied with all its rigour when the statute so prescribe and the Courts have no power to extend the period of limitation on equitable grounds."
