Querist : Anonymous (Querist) 23 May 2010 This query is : Resolved
could you explain and give the code in establishing the primafacie evidence in 498a?
Devajyoti Barman (Expert) 23 May 2010
There is no separate code for prima facie case in 498A case.In criminal trial including under section 498A IPC the frima facie case comes for consideration while accepting Charge sheet or sometimes while considering prayer for bail.
Prima facie case means whether on bare perusal of the information collected or documents supplied it can be concluded that the case may be initiated or certain charge may be framed. It is to be noted that the prima facie case has got no consideration in trial where the prosecution will have to prove the case beyond reasonable doubt.
