125 CrPC

(Querist) 03 August 2010 This query is : Resolved 
That in 125 CrPC proceeding I ha made an application for interim maintenance … the court grant it but the respondent did not deposit it inspite of order…. Now the case is fixed for cross examination of respondent but I wants that the respondent shall have to deposit it before cross examination….. how to compel the respondent to deposit it in court

Pls. Provide provisions alongwith Citations Regards..

Dear Mr.Chetan,

Your conditional plea of cross examination subject to deposit of arrears does not hold much water as you have sought to propound. On the other hand in the fitness of circumstances press your demand simultaneously side by side by carrying cross examination.

file an application on the ground of non compliance and wilful disobedience of the order os the court and seek appropriate action against the defaulter.

There are other provisions to compell payment.
